What is Adjudication?

 *ADJUDICATION        अभिनिर्णय* What is Adjudication? The process of valuing the immovable property and arriving at its market value and ascertaining the proper stamp duty is called adjudication. For adjudication, one can apply to the Collector of Stamps along with copy of the agreement containing the details of the property. In case of a signed document, adjudication must be done within one month otherwise two percent interest per month will be levied as penalty from the date of signature. An adjudicated unsigned document is valid up to six months from the date of adjudication order or up to December 31 of that year whichever is earlier. The adjudication processing fee payable is Rs.100. Why Adjudication? As per Maharashtra Stamp Act, it is compulsory to do Stamp Duty and Registration of the property documents. New definition of Associate Member

 Associate Member definition has been changed. As per MCS Ordinance 2019 -  “Associate Member” means husband, wife, father, mother, brother, sister, son, daughter, son-in-law, daughter-in-law, nephew, niece a person duly admitted to Membership of a housing society on written recommendation of a Member to exercise his rights and duties with his written prior consent and whose name does not stand in the share certificate. “Recovery of Dues in a Cooperative Housing Society after amendment of Sec 101 of MCS Act 1960 in 2019...” A common problem in housing societies (and quite a persistent one at that) is non-payment of dues by members. Defaulters often refuse to pay for common charges such as electricity, lift, water, service staff payments or even dodge overall maintenance charges. At times, the managing committee is found to be lax or apathetic to defaulting members and does not recover dues on time or in full. This is unfair to other residents who regularly pay their dues and they might have to bear the brunt of surplus charges that they are not responsible for. A member who has failed to pay dues for three consecutive months is considered a defaulter.  *सहकारसुत्र* (जनहितार्थ) *जाण कायद्याची.. गृहनिर्माण संस्थेची नोंदणी* सहकारी गृहनिर्माण संस्थांच्या नोंदणीची प्रक्रिया नोंदणीपूर्वी होणा-या पहिल्या सर्वसाधारण सभेच्या कामकाजापासून सुरू होते. या सभेत संस्थेविषयी सविस्तर विचारविनिमय केला जातो. मुख्य प्रवर्तकाची सर्वानुमते निवड केली जाते. संस्थेच्या नावाने बँकेत खाते उघडण्याची, त्याचप्रमाणे संस्थेचे नाव काय असावे हेही ठराव मंजूर केले जातात. नोंदणीपूर्वीचे वाद टाळण्यासाठी निबंधकाशी सल्ला मसलत करणे फायदेशीर ठरते. अन्यथा अडथळे निर्माण होऊ शकतात. सहकारी गृहनिर्माण संस्थांच्या नोंदणीची प्रक्रिया नोंदणीपूर्वी होणा-या पहिल्या सर्वसाधारण सभेच्या कामकाजापासून सुरू होते. या सभेत संस्थेविषयी सविस्तर विचारविनिमय करून मुख्य विषयांवर योग्य ठराव मंजूर करून निर्णय घेतले जातात. यावेळी निबंधकाची जबाबदारी मोठी असते. कारण, सभेत मुख्य प्रवर्तकाची निवड करणे, नियोजित संस्थेच्या नावाने बँकेत खाते उघडण्याची आणि संस्थेचे नाव राखून ठेवण्याची परवानगी मिळवण्यासाठी आवश्यक तो ठराव मंजूर केले आहेत की नाहीत, नियोजित संस्थेत एकूण किती सदनिका/गाळे आहेत, त्यापैकी किती गाळे

Society cant refuse digital payments

 डिजिटल पद्धतीने, कोणत्याही प्रकारे ऑनलाईन पद्धतीने केलेलं पेमेंट सोसायटी नाकारू शकत नाही,  अथवा त्यासाठी दंड आकारू शकत नाही, Society can not refuse any type of online payment.... Or can't charge any type of fine for such type of payment.....

Stamp Duty reduced in Maharashtra

To revive demand in the realty sector, the Maharashtra government last week reduced the stamp duty on property registration by 3% from 1 September to 31 December 2020, and by 2% from January 2021 to March 2021. Earlier, stamp duty charges were 5% in key cities such as Mumbai, Pune, Nagpur and Nashik, while 6% in others. According to experts, given the fact that many developers have rolled out or planning to roll out festive discounts, the move is likely to incentivise some of the fence-sitters to buy houses. “The reduction is technically like an instant flat discount on the cost of the property. A 2-3% reduction is significant if we consider the usual ticket size of a property purchase in a hyper-expensive city such as Mumbai. Stamp duty is a state levy paid to registrar. It is a fixed percentage levy and is charged on the transaction value or circle rate (minimum price of a property as per government), whichever is higher. While issuing the order, Anil Kawade, commissioner, Maharashtra cooperation and registrar of co-operative societies, said, “An order has been issued to all deputy registrars of co-operative societies to conduct general body meetings through video conferencing, emails; and all the decisions taken on digital mediums will be considered valid.” It is noted that co-operative societies in Maharashtra play a major role in the field of rural credit supply, mainly in the agro-industrial sector.
