 Draft Model Tenancy Act Gets Cabinet Approval The union cabinet, on June 2, 2021, approved the Model Tenancy Act. The draft law, which is expected to revolutionise the rental real estate market in India, was approved in a cabinet meeting chaired by prime minister Narendra Modi. The approved law will now be circulated to states and union territories, for adaptation by way of enacting fresh legislation or amending existing rental laws suitably. In an official statement, the Housing Ministry said that the law, which was first proposed in 2019, will help overhaul the legal framework with respect to rental housing across the country, which would help spur its overall growth. The Model Tenancy Act, which was approved by the Union Cabinet earlier this month, seeks to streamline the process of renting property in India and aid the rent economy in the estate sector. A delegation of Shiv Sena leaders Wednesday met Chief Minister Uddhav Thackeray and urged him not to implement the Model Tenancy Act, passed by the Union Cabinet, in Maharashtra. Claiming the Act will have an adverse impact on the 25 lakh tenants in Mumbai, the delegation handed over a letter, signed by state Transport Minister Anil Parab, MP and party’s chief spokesperson Arvind Sawant, MP and party secretary Anil Desai and a few others, to Thackeray. “There is no need for a new Act to regulate rent. The Union Cabinet on June 2, 2021 approved the Model Tenancy Act, aiming to bring about wide-ranging reforms to "unlock over one crore vacant houses" and bridge the trust deficit between landlords and tenants. Some of the reforms include setting up separate rent authorities, courts and tribunals in every district to ensure speedy dispute resolution and establishing a fair mechanism to revise rents to protect tenants against arbitrary hikes while also keeping in view the owners' economic interests.
