 *Bombay HC Rebukes Civic Agencies Over Inaction Against Illegal Buildings* Satark Nagrik Foundation expresses satisfaction. Commenting on the illegal buildings and structure collapses that have resulted in the loss of life, the Bombay High Court said on Thursday, January 15, 2021, that “the situation will become quite difficult” in cities if corporations didn’t take up the responsibility of tackling these structures. The division bench with Chief Justice Dipankar Datta and Justice Girish S Kulkarni asked for ward-wise information from eight municipal corporations in the Mumbai Metropolitan Region (MMR) as well as the BMC.  The bench is seeking data on notices issued to unauthorized buildings, the steps that were taken after, along with information on cases that are under litigation and cases wherein compensation was recovered by the agency.  Further, the bench also asked the State Government to think about establishing a separate tribunal to speed up hearings on existing cases pertain

 *जागो_ग्राहक* घर खरेदीदारांची फसवणूक करणाऱ्या बांधकाम व्यावसायिकांना (बिल्डर) एक ते पाच वर्षे तुरुंगवास अशी मोफा कायद्यात तरदूत आहे: 1) करारात ठरलेल्या तारखेला घराचा ताबा न देणे,  2) ताबा देताना "सीसी‘ व "ओसी‘ (कम्प्लिशन सर्टिफिकेट आणि ऑक्‍युपेशन सर्टिफिकेट) न देणे,  3) बांधकामाच्या जागेवर मान्यताप्राप्त नकाशा न लावणे,  4) कराराची नोंदणी न करणे,  5) खरेदीदारांकडून घेतलेली रक्कम वेगळ्या बॅंक खात्यात जमा न करणे,  6) नकाशानुसार बांधकाम न करणे,  7) ठरल्यापेक्षा जास्त मजले बांधणे अथवा जास्त बांधकाम करणे,  8) 60 टक्के खरेदीदारांबरोबर करार केल्यावर चार महिन्यांत सहकारी गृहनिर्माण संस्थेची स्थापना न करणे, 9) सोसायटीची स्थापना झाल्यावर चार महिन्यांत अभिहस्तांतर (कन्व्हेअन्स) न करणे, आदी प्रकारे फसवणूक करणाऱ्या बांधकाम व्यावसायिकांविरुद्ध महाराष्ट्र फ्लॅट ओनरशिप ऍक्‍टमधील (मोफा) तरतुदींनुसार गुन्हा नोंदवला जाईल, असे परिपत्रक राज्याचे विशेष पोलिस महानिरीक्षक प्रभात कुमार यांनी काढले आहे.  ग्राहकांची फसवणूक करणाऱ्या बांधकाम व्यावसायिकांविरुद्ध गुन्हा नोंदविण्याचे आदेश पोलिसांना द्यावेत,

 *DEEMED CONVEYANCE DRIVE BY MAHARASHTRA GOVT : What use is it?* • Government of Maharashtra have issued notification for a special drive to issue Deemed Conveyance deed upto 15th January, 2021. The same has now been extended upto January 31,2021. • *According to me, this drive is just an eyewash.* • *A similar drive was held in 2012-13 in which our NGO had whole heartedly participated but all our efforts, time and money went waste because of the deeply embedded corruption in our system.* • The entire process of Deemed Conveyance takes atleast a year.  *Conveyance of Land & Building in favour of Housing Society:* ◆ Conveyance is a Transfer the Title of Land and Building by the Builder/Developer/Owner of the land in favour of Housing Society by execution of Conveyance Deed. As per the Housing Society Bye-Laws, the main objective of formation of the Society is to obtain the Conveyance and if Conveyance is not executed by the Builder/Owner within four months from the date of Registration of the Society, a case can be filed against the Builder/Owner of the land to obtain the Conveyance.
