Shiv Sena urges CM Uddhav not to implement Model Tenancy Act in Maharashtra. The Model Tenancy Act, which was approved by the Union Cabinet earlier this month, seeks to streamline the process of renting property in India and aid the rent economy in the estate sector. A delegation of Shiv Sena leaders Wednesday met Chief Minister Uddhav Thackeray and urged him not to implement the Model Tenancy Act, passed by the Union Cabinet, in Maharashtra. Claiming the Act will have an adverse impact on the 25 lakh tenants in Mumbai, the delegation handed over a letter, signed by state Transport Minister Anil Parab, MP and party’s chief spokesperson Arvind Sawant, MP and party secretary Anil Desai and a few others, to Thackeray. “There is no need for a new Act to regulate rent. Mumbai Pagdi Tenants have to pay Market Rate Rent as per new Model Rent Act The government while pursuing its ambitious dream to provide ‘Housing for All by 2022’, the Central Government circulated the draft Model Rent Act, in order to boost supply in the rental housing segment. The Model Tenancy Act was enacted to establish the Rent Authority for regulating renting of premises in an efficient and transparent manner and to balance the interests of owner and tenant by establishing adjudicating mechanism for speedy dispute redressal and to establish Rent Court and Rent Tribunal to hear appeals and for matters connected therewith or incidental thereto. The Rent Act, a legacy of the British Raj, froze rents, made it extremely difficult for landlords to evict tenants and made tenancy inheritable. Landlords, in order to generate some value from their properties, started a system of transaction called pagdi, using money as an inducement for the tenant to leave the property. The incom...

All you need to know about the Pagdi system Introduction to the Pagdi System Many times, one must have come across the term ‘Pagdi‘ while reading or hearing about real estate-related work. What is the Pagdi or Pagdi System? Pagdi is a traditional and unique tenancy model in India since the pre-Independence era, although the number of people, who are tenants under such a system today, may not be high. Similar to other renting arrangements, it also involves a tenant and a landlord, and pays a nominal rent as compared to market rates, on the other hand, the difference is that the tenant is also the co-owner of the property, and has both subletting and selling rights. Origin and the history of the Pagdi System The “pagdi-kirayedar” system was started in the pre-independence era to evade taxes paid to the British government. Under this system, verbal/oral agreements played an important role in transfer of property, wherein the tenants were given a receipt for the rent paid and further ...

What is the Model Tenancy Act 2020? The Union Cabinet on June 2, 2021 approved the Model Tenancy Act, aiming to bring about wide-ranging reforms to "unlock over one crore vacant houses" and bridge the trust deficit between landlords and tenants. Some of the reforms include setting up separate rent authorities, courts and tribunals in every district to ensure speedy dispute resolution and establishing a fair mechanism to revise rents to protect tenants against arbitrary hikes while also keeping in view the owners' economic interests. The law seeks to balance out the renter's interests with tenants, who have enjoyed protection against eviction and rent hikes under laws that were drafted decades ago and mostly with the intent of preventing exploitation of tenants by landlords. The Model Tenancy Act is the government's efforts to enable the institutionalisation of rental housing by gradually shifting it towards the formal market. In a statement, the government said t...
