The development assumes significance as it clarifies that the authority will be protecting homebuyers and not investors in any project The  Maharashtra Real Estate   Regulatory Authority ( MahaRERA ) has dismissed a complaint filed by an investor in  Monarch Solitaire ’s housing project against the realty developer, saying the dispute is of civil nature and does not pertain to any contravention of the Real Estate (Regulation & Development) Act, 2016. The development assumes significance as it clarifies that the authority will be protecting homebuyers and not investors in any project. In 2014, the complainant had invested in the residential project of Monarch Solitaire and reserved four apartments in it. The project is registered under MahaRERA. The Government can, contrary to the builders’ plea, make a law which has the effect of changing obligations under an existing contract said advocate general Ashutosh Kumbhakoni - Swati Deshpande The Center and State on Friday stressed that a law can be made in public interest to overturn a private contract. Both were defending the new  Real Estate  (regulation and Development) Act ( RERA ) and its provisions against a constitutional challenge from builders who questioned its retroactive application on pending projects under old agreements. The Government can, contrary to the builders’ plea, make a law which has the effect of changing obligations under an existing contract said advocate general Ashutosh Kumbhakoni, citing apex court judgments to emphasize that RERA has a ‘retroactive’’ application on pending unfinished projects. Kumbhakoni said, “there is no constitutional guarantee that the terms of a contract will have to maintained. The legislature is empowered to bring...

Mumbai: Housing societies on govt land wait for ownership

The state government allotted land to many cooperative housing societies in and around Mumbai between 1950s and 1980s to promote “cooperation movement” in the state. - Makarand Gadgil The residents of 3,000-odd housing societies built on government land across Mumbai are not amused with the advertisement blitzkrieg tomtoming the achievements of the  Devendra Fadnavis administration, which completed three years in office on October 31. While the government, through these advertisements, is trying to project how people are happy with its various initiatives and how it has fulfilled promises like loan waiver for farmers, the residents point out that they are still waiting for the state to frame rules to implement its own decision of making housing societies freehold owners of the land on which the buildings stand. The delay, the residents claim, is hampering redevelopment of the housing complexes. There are over 20,000 such societies spread across the state. The state government ...

NCDRC directs Mumbai builder to complete decade-old 60-storey project in 3 years

The order puts at ease over a dozen buyers who had booked flats in RNA Metropolis The  National Consumer Disputes Redressal Commission  has directed a builder to complete within three years a 60-storey skyscraper that has been under construction for a decade at Sewri West, and compensate the buyers for the delay. The allotment dates for the flats were between 2010 and 2014. The commission rejected as “very unreasonable’’ the offer of  East and West Builders , a  RNA Corp group  company, to complete the work in the next five years. Significantly, in a strong finding that may shake up other builders, the apex consumer body held that the builder cannot attribute the “abnormal delay’’ to a 2012 amendment to the Development Control Regulations (DCR). The project has to be now completed under the provisions of the new  Real Estate  (Regulation and Development) Act (RERA). The order puts at ease over a dozen buyers who had booked flats in RNA Metropolis. T...
