RERA and OC
The Real Estate Regulatory Authority (RERA) in Maharashtra requires builders to obtain an Occupancy Certificate (OC) within three months. If a builder fails to do so, they may be fined.
Explanation
The RERA Act requires builders to obtain an OC or Completion Certificate (CC) before handing over the property to the buyer.
The local municipal authorities issue the OC after inspecting the building and verifying compliance with building laws.
The process of getting an OC can take 30–60 days.
If a builder delays possession of the property, the buyer can file a grievance with the state RERA.
The RERA may order the builder to pay interest to the buyer for each month of delay.
The National Consumer Disputes Redressal Commission (NCDRC) may allow buyers to seek a refund if the delay is more than one year.
